Welcome to Eucarl ("Eucarl", "we", "our", or "us").

These Terms of Service ("Terms") govern your access to and use of the Eucarl website, applications, and related services (collectively, the "Service").

By accessing or using Eucarl, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Eligibility

You must be at least 13 years old, or the minimum age required by the laws of your country, whichever is higher.

By using Eucarl, you represent that you meet this requirement and have the legal capacity to enter into this agreement.

2. Nature of the Platform

Eucarl is an anonymous community platform where users may publish content, participate in discussions, create journals, answer polls, send anonymous messages, and interact with other users.

Eucarl is a platform provider only.

Eucarl does not create, verify, edit, investigate, or endorse the opinions, advice, statements, or information posted by users.

User-generated content reflects the views of its respective authors and not those of Eucarl.

3. User Responsibility

You are solely responsible for:

  • every post you publish;

  • every comment you submit;

  • every anonymous message you send;

  • every journal you create;

  • every poll response you submit;

  • every file, image, or other content you upload;

  • every interaction you have through the Service.

You agree that you—not Eucarl—are legally responsible for your own conduct and content.

4. Acceptable Use

You agree not to use Eucarl to:

  • violate any law or regulation;

  • harass, threaten, intimidate, stalk, or abuse another person;

  • impersonate another person or organization;

  • publish defamatory or knowingly false statements;

  • disclose another person's private or confidential information without permission;

  • infringe copyrights, trademarks, patents, or other intellectual property rights;

  • publish unlawful sexual content or exploitative material;

  • exploit, endanger, groom, or sexualize minors;

  • promote terrorism, violent extremism, organized crime, or human trafficking;

  • distribute malware, viruses, phishing links, or malicious code;

  • commit fraud, scams, identity theft, or financial deception;

  • encourage self-harm, suicide, or violence;

  • promote illegal drug trafficking or other unlawful activity;

  • interfere with the operation or security of the Service;

  • scrape, crawl, reverse engineer, or attempt unauthorized access to Eucarl or its systems;

  • artificially manipulate votes, engagement, rankings, or platform metrics;

  • create multiple accounts for abusive purposes;

  • evade enforcement actions taken against your account.

Attempting to use the Service in these ways may result in immediate removal of content, suspension or termination of your account, reporting to appropriate authorities where required, and any other action permitted by law.

5. Anonymous Accounts

Eucarl allows anonymous participation.

Anonymous does not mean exempt from the law.

We may retain technical records, including server logs and security information, for fraud prevention, abuse investigations, legal compliance, and protection of the Service.

Where required by law or a valid legal process, Eucarl may disclose relevant information to competent authorities.

6. Content Ownership

You retain ownership of the content you submit.

However, by posting content on Eucarl, you grant Eucarl a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, display, distribute, adapt (for formatting or technical purposes), moderate, and make your content available as necessary to operate, improve, promote, secure, and provide the Service.

This license ends when your content is deleted, except to the extent copies remain in backups, moderation records, legal archives, or where continued retention is permitted or required by law.

7. Content Moderation

Eucarl reserves the unrestricted right, but not the obligation, to:

  • review content;

  • approve or reject submissions;

  • edit formatting;

  • restrict visibility;

  • remove content;

  • disable comments;

  • lock discussions;

  • suspend or terminate accounts;

  • refuse publication for any reason consistent with applicable law.

Moderation may be performed by automated systems, human moderators, or both.

Failure to remove particular content does not constitute approval, endorsement, or acceptance of that content.

8. No Professional Advice

Content published on Eucarl is provided by users.

Nothing on Eucarl constitutes professional medical, legal, financial, psychological, investment, employment, relationship, or other professional advice.

You should seek qualified professional advice before relying on any information obtained through the Service.

Your reliance on user-generated content is entirely at your own risk.

9. No Guarantee of Accuracy

Eucarl does not guarantee that any content is:

  • accurate;

  • complete;

  • truthful;

  • current;

  • reliable;

  • lawful;

  • safe; or

  • suitable for any purpose.

Users should independently evaluate all information.

10. User Interactions

Eucarl is not responsible for interactions between users, whether online or offline.

Any communication, relationship, transaction, dispute, or meeting between users is solely their own responsibility.

11. Reporting Violations

Users are encouraged to report content believed to violate these Terms or applicable law.

Eucarl may investigate reports but does not guarantee any particular outcome or response time.

12. Intellectual Property

Except for user-generated content, all software, branding, logos, design elements, graphics, code, text, and other materials provided by Eucarl are owned by or licensed to Eucarl and are protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, modify, or commercially exploit Eucarl's intellectual property without prior written permission.

13. Third-Party Services

The Service may include links, advertisements, embedded content, or integrations from third parties.

Eucarl does not control and is not responsible for the content, privacy practices, availability, products, or services of third parties.

Your dealings with third parties are solely between you and the applicable third party.

14. Service Availability

Eucarl is provided on an "AS IS" and "AS AVAILABLE" basis.

We do not guarantee that the Service will be uninterrupted, secure, error-free, or available at all times.

We may modify, suspend, discontinue, or remove any feature at any time without prior notice.

15. Disclaimer of Warranties

To the fullest extent permitted by applicable law, Eucarl disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, security, accuracy, and reliability.

16. Limitation of Liability

To the fullest extent permitted by applicable law, Eucarl, its owners, operators, employees, contractors, volunteers, moderators, licensors, affiliates, successors, and assigns shall not be liable for any indirect, incidental, consequential, exemplary, punitive, special, or similar damages, including loss of profits, revenue, goodwill, business opportunities, data, reputation, or other intangible losses arising out of or relating to the use of, inability to use, or reliance upon the Service.

Where the law permits a limitation of direct damages, Eucarl's total aggregate liability arising from the Service shall not exceed the greater of the amount you paid to Eucarl for the Service during the twelve months immediately preceding the claim or one hundred Canadian dollars (CAD $100).

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

17. Indemnification

You agree to defend, indemnify, and hold harmless Eucarl, its owners, operators, employees, moderators, contractors, affiliates, successors, licensors, and agents from and against any claims, demands, actions, proceedings, liabilities, damages, judgments, losses, fines, penalties, costs, and expenses (including reasonable legal fees) arising from or related to:

  • your use of the Service;

  • your violation of these Terms;

  • your violation of any law or regulation;

  • your user-generated content;

  • your infringement of another person's rights;

  • your interactions with other users.

18. Suspension and Termination

Eucarl may suspend, restrict, or permanently terminate access to the Service at any time, with or without notice, where we reasonably believe it is necessary to protect the Service, comply with legal obligations, enforce these Terms, or prevent abuse.

Termination does not limit any legal rights or remedies available to Eucarl.

19. Privacy

Your use of the Service is also governed by the Eucarl Privacy Policy, which forms part of these Terms.

20. Changes to the Service

We may modify, add, remove, or discontinue any feature, functionality, community, or service at any time without liability, subject to applicable law.

21. Changes to These Terms

We may revise these Terms from time to time.

Material changes will become effective after being posted on the Service unless otherwise required by applicable law.

Your continued use of Eucarl after revised Terms take effect constitutes acceptance of the updated Terms.

22. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws applicable in the jurisdiction in which the owner of Eucarl has established the Service, without regard to conflict of law principles, except where mandatory consumer protection laws require otherwise.

If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force and effect.

23. Entire Agreement

These Terms, together with the Privacy Policy and any other policies incorporated by reference, constitute the entire agreement between you and Eucarl regarding your use of the Service and supersede any prior agreements relating to the same subject matter.
